1. Acceptance of Terms

By accessing, downloading, or using the application, website, or services provided by ACR TECH ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not access or use our Service.

2. License to Use

ACR TECH grants you a limited, non-exclusive, non-transferable, revocable license to use the app and website for personal or internal business purposes strictly in accordance with these terms. You agree not to copy, modify, reverse engineer, decompile, rent, sell, or distribute any portion of the platform without our prior written consent.

3. AI Services and Third-Party API Integrations

Our platform incorporates and relies upon third-party Artificial Intelligence (AI) platforms, APIs, models, and sub-processors (including, but not limited to, OpenAI, Google Gemini, NanoBana, and other specialized AI model providers). By using our Service, you explicitly acknowledge and agree that:

• Dynamic Model Infrastructure: We may utilize, routing through, or switch between various underlying AI models provided by third parties to process your input requests, images, prompt texts, and parameters.
• No Control Over Third-Party Outputs: Outputs generated by AI models are non-deterministic, probabilistic, and produced by third-party algorithms. ACR TECH does not guarantee the accuracy, uniqueness, copyrightability, safety, or quality of any AI-generated media or content.
• Compliance with Third-Party Terms: Your use of AI features must comply with the terms of service, acceptable use policies, and guidelines of our underlying third-party AI providers.

4. User Content, Inputs, and Generated Outputs

You retain responsibility for all text prompts, images, photos, and other materials you upload or input into the app ("User Content").

• Rights to Inputs: You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to upload User Content, including facial images or media containing third-party copyrights or personal likenesses.
• AI Output Ownership & Use: Subject to third-party provider terms and applicable intellectual property laws, you are granted rights to use the generated output. However, due to the nature of machine learning, outputs generated for you may be similar or identical to outputs generated for other users.
• Harmful Content Prohibition: You are strictly prohibited from generating or uploading content that is illegal, defamatory, pornographic, hateful, violent, or infringing upon any third party’s intellectual property or privacy rights.

5. Subscriptions, Billing, and In-App Purchases

Certain features or generation quotas require a paid subscription or credit package. Payments are processed securely via third-party billing networks (e.g., Google Play Store, Apple App Store, or Stripe). Subscriptions auto-renew unless canceled at least 24 hours prior to the end of the current billing cycle through your mobile store account settings.

6. Intellectual Property Rights

All software code, branding, logos, app architecture, user interfaces, graphics, and underlying assets associated with ACR TECH are the exclusive property of ACR TECH or its licensors. Nothing in these terms transfers any ownership rights of our core platform technology to you.

7. Prohibited Conduct

You agree not to attempt to bypass rate limits, probe system vulnerabilities, inject malicious code, use automated bots, scrape outputs, or use AI outputs to train competing machine learning models without express authorization.

8. Refunds and Cancellations

All purchases, credit packs, and subscription fees are non-refundable except where mandated by local law or specified by the governing store platform policies (such as Google Play refund policies). Unused AI processing generation credits carry no cash value.

9. Disclaimer of Warranties & Limitation of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACR TECH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. UNDER NO CIRCUMSTANCES SHALL ACR TECH, ITS DIRECTORS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, GENERATION FAILURES, SERVICE INTERRUPTIONS, OR COPYRIGHT INFRINGEMENT ARISING OUT OF THIRD-PARTY AI-GENERATED OUTPUTS.

10. Indemnification

You agree to defend, indemnify, and hold harmless ACR TECH from and against any claims, liabilities, damages, losses, or legal expenses (including attorney fees) resulting from your violation of these terms, misuse of the app, or infringement of third-party rights through uploaded media or generated content.

11. Modifications and Service Termination

We reserve the right to alter, update, or discontinue any feature, AI model integration, or subscription offering at any time. We may suspend or terminate your account immediately if you breach these terms.
